Terms of Service

Article 1 (Purpose)

Article 2 (Definitions)

1. (1) The terms used in these Terms have the following meanings.
   1. 1. "Member" means a person who has agreed to these Terms and entered into a service agreement with the Company.
   2. 2. "Account" means the combination of an ID and a password chosen by a Member and approved by the Company to identify the Member and let them use the Service.
   3. 3. "Character" means the persona a Member uses within the Service.
   4. 4. "Post" means any information a Member submits to the Service, such as writing, chat, messages and nicknames.
   5. 5. "Cash" means the electronic currency used to purchase paid items within the Service, consisting of Paid Cash and Free Cash.
   6. 6. "Paid Cash" means Cash a Member receives by paying for it.
   7. 7. "Free Cash" means Cash the Company gives without charge, such as top-up bonuses, event rewards and compensation.
   8. 8. "Gold" means the in-game currency earned in the Service.
   9. 9. "Hour pass" means a paid item whose effect applies for a fixed period, and "Bundle" means a paid item that bundles several effects.
   10. 10. "Chance item" means a paid item whose result is decided by probability, such as tempering gear, rolling a gear option and ascension.
   11. 11. "Rank" means the membership tier decided by the amount a Member has paid in the last 30 days.
   12. 12. "Succession" means closing the current Character and continuing the game with a Character of the next generation.
   13. 13. "Council" means the in-Service board where Members read and write posts.
   14. 14. "Update" means adding, changing or removing the content, features, figures or composition of the Service.
   15. 15. "Operating Policy" means the matters needed to apply these Terms, including game rules, that the Company sets and posts within the Service.
2. (2) Terms not defined here follow the relevant laws and general commercial practice.

Article 3 (Company Information)

Article 4 (Posting and Amendment of the Terms)

1. (1) The Company posts these Terms on the Service screen so Members can view them at any time.
2. (2) The Company may amend these Terms within the limits of the relevant laws, such as the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce and the Content Industry Promotion Act.
3. (3) When amending the Terms, the Company announces the effective date, the changes and the reasons on the first screen of the Service from 7 days before the effective date. Changes that are unfavorable to Members or significant are announced from 30 days before the effective date and are also sent to each Member by in-game message.
4. (4) If the Company, when announcing or notifying under paragraph (3), states that a Member who does not object by the effective date will be deemed to accept the amended Terms, and the Member does not object, the Member is deemed to have accepted the amended Terms.
5. (5) A Member who does not accept the amended Terms may terminate the service agreement.

Article 5 (Matters Not Covered)

Article 6 (Operating Policy)

1. (1) The Company may set, as its Operating Policy, matters needed to apply these Terms and matters these Terms delegate within a specific scope, and posts it on the rules screen of the Service.
2. (2) If the Operating Policy is changed in a way that significantly changes Members' rights or obligations, or has the same effect as changing these Terms, the procedure in Article 4 applies.

Article 7 (Application and Acceptance)

1. (1) The service agreement is concluded when an applicant agrees to these Terms and to the collection and use of personal information, applies for membership, and the Company accepts the application.
2. (2) Persons under the age of 14 cannot become Members.
3. (3) The Company may refuse an application that falls under any of the following, and may terminate the agreement if it learns of it after acceptance.
   1. 1. The applicant used another person's information or gave false information.
   2. 2. A Member under a usage restriction applies again during the restriction.
   3. 3. The applicant tries to sign up by automated means or creates many accounts in a short time.
   4. 4. The application violates the relevant laws or aims to harm public order and good morals.

Article 8 (Account Management)

1. (1) One Account holds one Character.
2. (2) Members are responsible for managing their ID and password. A Member who learns that someone else is using their Account must tell the Company immediately.
3. (3) Members may not sell, lend or transfer their Account to others. The Company does not restore or compensate for losses caused by breaking this rule.
4. (4) Members can change their password, language and other information on the settings screen.

Article 9 (Protection of Personal Information)

1. (1) The Company collects only the minimum personal information needed to provide the Service and protects it under the relevant laws, such as the Personal Information Protection Act, and its Privacy Policy.
2. (2) The Company does not provide personal information to third parties without the Member's consent, except where it provides necessary information to its payment processor to handle payments and refunds, or where required under procedures set by law.
3. (3) When a Member leaves, the Company destroys their personal information without delay, except information the law requires it to keep. Details follow the Privacy Policy.

Article 10 (Obligations of the Company)

1. (1) The Company complies with the relevant laws and these Terms and strives to provide the Service continuously and stably.
2. (2) The Company fixes faults in the Service as quickly as possible.
3. (3) If the Company finds an opinion or complaint raised by a Member justified, it handles it and tells the Member the result.

Article 11 (Obligations of Members)

1. (1) Members must not do any of the following.
   1. 1. Giving false information when signing up or changing information
   2. 2. Using another person's Account or using another person's personal information without permission
   3. 3. Impersonating the Company's operators or staff
   4. 4. Accessing the Service or operating it automatically with programs, devices or tools the Company has not provided or approved
   5. 5. Profiting from an error or defect in the Service knowingly, or spreading the method to others
   6. 6. Selling or pledging Accounts, Characters, items, Gold or other in-game information for money, or otherwise disposing of it for value
   7. 7. Harming the fairness of the game, such as creating several accounts to gather resources in one place
   8. 8. Harassing, insulting or defaming other Members
   9. 9. Posting obscene or violent information, or other information against public order and good morals
   10. 10. Infringing the copyrights or other intellectual property rights of the Company or third parties
   11. 11. Disrupting the operation of the Service or putting an unreasonable load on its servers
   12. 12. Any other act that violates the relevant laws or the Operating Policy
2. (2) Members must follow these Terms, the Operating Policy and the notices the Company posts within the Service.

Article 12 (Provision and Suspension of the Service)

1. (1) In principle the Service is provided 24 hours a day, all year round.
2. (2) The Company may suspend all or part of the Service temporarily for inspection, replacement or failure of equipment, communication failure, or other substantial operational reasons. Scheduled maintenance is announced in advance.
3. (3) If the Service is suspended for more than 4 hours in a day without notice for reasons attributable to the Company, the Company extends the period of Hour passes by three times the suspended time.

Article 13 (Termination of the Service)

1. (1) If the Company ends the Service, it announces this on the first screen of the Service at least 30 days before the end date and also tells each Member by in-game message.
2. (2) After ending the Service, the Company keeps a refund desk open for at least 30 days, and during that period refunds remaining Paid Cash and Hour passes and Bundles with time left, in line with the Content User Protection Guidelines.
3. (3) Free Cash and items, Gold and other things earned in the game are not refunded.

Article 14 (Changes to the Service)

1. (1) The Company may change the content of the Service, such as hunting grounds, monsters, items, prices, probabilities and balance, as needed for operation or technology.
2. (2) If a change greatly reduces the value of paid items already sold, the Company announces the change and its reasons before applying it and, where needed, exchanges them for equivalent items or usage periods.
3. (3) When changing the probabilities of Chance items, the Company announces the change before applying it and updates the Odds page at the same time.

Article 15 (Updates and Disclaimer)

1. (1) The Company may update the Service at any time to improve quality, fix errors, strengthen security, adjust balance, add new content and so on.
2. (2) Updates may add, change or remove elements of the Service, including the stats and effects of Characters, classes, skills, items and gear, the make-up of hunting grounds and monsters, rewards and drop rates, Gold income and prices, and the probabilities of Chance items.
3. (3) The Company announces updates within the Service before applying them. Urgent changes that cannot be announced in advance, such as error fixes and security measures, are announced without delay after they are applied.
4. (4) Changes under paragraph (2) arise in the course of operating and improving the Service. The Company is not liable to compensate a Member merely because the Member expected the stats, effects, value or way of use before the update to remain. This does not apply to damage caused by the Company's intent or gross negligence.
5. (5) Notwithstanding paragraph (4), if an update greatly reduces the value of paid items already sold, Article 14(2) applies.
6. (6) Once an update is applied, earlier versions are no longer served. Unless the Company acted with intent or gross negligence, it is not liable if a Member cannot use the Service normally because they did not update the app or because old files remain in their browser.
7. (7) If an error during an update grants or deducts in-game resources or items by mistake, the Company may correct it: anything granted by mistake is recovered, and anything deducted by mistake is returned.
8. (8) If the Service becomes unstable and stops right after an update, Article 12 applies.

Article 16 (Keeping of Conversations)

1. (1) The Company may store and keep chats, messages and posts between Members.
2. (2) The Company views the information in paragraph (1) only when needed to mediate disputes, handle complaints or keep order in the game, and does not provide it to third parties unless required by law.

Article 17 (Management of Posts)

1. (1) The copyright in a post a Member writes on the Council or elsewhere belongs to that Member.
2. (2) The Company may delete or hide a post that falls under any of the following, and after doing so tells the Member what was done and why by in-game message.
   1. 1. Content that insults or defames others
   2. 2. Obscene content
   3. 3. Content that infringes the copyrights or other rights of others
   4. 4. Advertising, or repeatedly posting the same content
   5. 5. Other content that violates the relevant laws
3. (3) Members may ask about the reason for an action on a post at incode@gmail.com.

Article 18 (Ownership of Rights)

1. (1) The rights to works the Company creates in the Service, such as images, text, sound and rules, belong to the Company.
2. (2) Members may use the Company's works only within the scope of using the Service, and may not copy, distribute, transmit or use them for profit without the Company's permission.

Article 19 (Right to Use In-game Information)

1. (1) The Company grants Members the right to use the Service. Members may not transfer this right to others or pledge it.
2. (2) Characters, items, Gold and other in-game information are rights of use that exist only within the Service. The Company does not exchange them for cash or other property.

Article 20 (Cash)

1. (1) Cash is divided into Paid Cash and Free Cash. The portion a Member receives for payment is given as Paid Cash, and the portion received as top-up bonuses, events and the like is given as Free Cash.
2. (2) When a Member uses Cash, Paid Cash is deducted first, and Free Cash is deducted only after all Paid Cash has been used. Paid Cash is deemed to be deducted in the order it was purchased.
3. (3) Paid Cash is given at 1 Cash for every 10 won paid. If the Company changes this rate, it announces the change in advance, and Cash a Member already holds keeps the rate at which it was bought.
4. (4) A top-up starts from 1,000 won, and limits set by card companies or the payment processor may apply first. A bonus of 1% is given as Free Cash for every 20,000 won topped up, up to 300%.
5. (5) Prices in the Cash shop are the same for all Members regardless of Rank. Rank affects only the daily benefits.
6. (6) The probability of each kind of Chance item is posted in full on the Odds page, and changes are announced before they apply. Items without probabilities, such as Hour passes and Bundles, have fixed contents known before purchase.

Article 21 (Succession of Characters)

1. (1) When a Character is succeeded, the Character of the previous generation remains only as a record.
2. (2) On succession, Cash and ascension steps carry over to the next generation unchanged. Gold in the purse and the bank carries over after inheritance tax, and the tax rate is posted on the succession screen.
3. (3) The purse limit and bag slots expanded with Cash, Crack Wards and name colours also carry over to the next generation unchanged.

Article 22 (Withdrawal of Purchase)

1. (1) A Member may withdraw a purchase of Paid Cash within 7 days from the later of the purchase date and the date it became available.
2. (2) However, Paid Cash the Member has already used (Cash used to buy items) cannot be withdrawn under Article 17(2) of the Act on Consumer Protection in Electronic Commerce. Withdrawal is possible only for Paid Cash that remains unused. The Company displays this on the payment screen.
3. (3) Notwithstanding paragraphs (1) and (2), if the content of a paid item differs from what was displayed or advertised, or the contract is performed differently from its terms, the Member may withdraw within 30 days from the date they learned or could have learned of it, and within 3 months of the purchase date.
4. (4) To withdraw, email incode@gmail.com with your ID and the payment date.
5. (5) The Company cannot cancel payments made in the app directly; please request cancellation through the app store's procedure.

Article 23 (Effect of Withdrawal)

1. (1) The Company returns the payment by the original payment method within 3 business days of receiving the withdrawal request. No fee or penalty is charged for withdrawal.
2. (2) On withdrawal, the Company recovers the withdrawn Paid Cash together with the Free Cash given as that payment's bonus in proportion to the withdrawn Paid Cash. If there is not enough Free Cash to recover, 10 won is deducted from the refund for each missing Free Cash.

Article 24 (Refund of Remaining Paid Cash)

1. (1) Even after the withdrawal period under Article 22 has passed, a Member may request a refund of Paid Cash that remains unused.
2. (2) In that case the Company refunds the amount corresponding to the remaining Paid Cash (10 won per Cash) minus a refund fee of 10% and the fee for transferring the refund. Bonus Free Cash is recovered, or its amount deducted, in the same way as Article 23(2).
3. (3) Free Cash is not refunded.
4. (4) The fee in paragraph (2) is not charged in the following cases.
   1. 1. Withdrawal under Article 22
   2. 2. Refunds of overpayments under Article 25
   3. 3. Refunds because the Service could not be used for reasons attributable to the Company
   4. 4. Refunds due to the end of the Service under Article 13
   5. 5. Cancellation of a contract under Article 26
5. (5) To request a refund, email incode@gmail.com with your ID and the account to receive the refund. The Company processes it within 3 business days of receiving the request.

Article 25 (Overpayments)

1. (1) If an overpayment occurs, the Company returns the full overpaid amount by the original payment method. If it cannot be returned that way, the Company says so in advance.
2. (2) If the overpayment is attributable to the Company, the Company bears the cost of the refund. If it is attributable to the Member, the Member may bear the cost of the refund within a reasonable range.
3. (3) If the Company refuses to refund an overpayment a Member claims, the Company bears the burden of proving there was no overpayment.

Article 26 (Payments by Minors and Cancellation)

1. (1) Members under 19 must obtain the consent of their legal representative before paying.
2. (2) A payment made without the legal representative's consent may be cancelled by the minor or the legal representative. It cannot be cancelled, however, if the minor used deception to make others believe they were an adult or had the representative's consent, or if the payment was made within property the representative allowed the minor to dispose of.
3. (3) To request cancellation, write to incode@gmail.com and send a document proving the family relationship.
4. (4) When a payment is cancelled, the Company returns the payment and recovers whatever remains of the Cash given for that payment.

Article 27 (Termination by Members)

1. (1) Members may terminate the service agreement (leave) at any time, directly on the settings screen or by writing to incode@gmail.com.
2. (2) A Member who has items on sale or open buy orders on the market, or who is the king of a nation, can leave after settling these, to prevent harm to other Members.
3. (3) On leaving, the ID and nickname are replaced with unidentifiable values and the password and access records are erased. The Character stops all activity and cannot be restored. Character names and trade records entangled with other Members' records are not erased.
4. (4) The ID and nickname of a Member who left become available to others, but the Character name stays in the records and cannot be reused.
5. (5) On leaving, remaining Cash, Gold and the like are extinguished. A Member with Paid Cash to be refunded must request the refund under Article 24 before leaving.

Article 28 (Usage Restrictions)

1. (1) If a Member violates these Terms or the Operating Policy, the Company may restrict use of the Service in the order of warning, suspension for a period and permanent suspension. For serious harm to other Members or the Service, such as account theft, automated operation or abuse of defects, the Company may restrict use without following this order.
2. (2) Detailed criteria for each reason for restriction may be set in the Operating Policy.
3. (3) If a restriction is justified, the Company does not compensate for damage the Member suffers from it.

Article 29 (Temporary Restrictions)

1. (1) If hacking, account theft, a payment incident or the like is suspected, the Company may temporarily stop use of the Account until the check is complete.
2. (2) If the check shows the Member was not at fault, the Company extends the period of Hour passes by the number of days use was stopped.

Article 30 (Procedure for Restrictions)

1. (1) When restricting use, the Company tells the Member what was violated and how long the restriction lasts.
2. (2) In urgent cases, the Company may restrict first and notify without delay afterwards.

Article 31 (Objections to Restrictions)

1. (1) A Member who objects to a restriction may file an objection at incode@gmail.com within 15 days of receiving the notice.
2. (2) The Company answers within 15 days of receiving the objection. If it cannot answer within that period, it tells the Member why and when it will.
3. (3) If the Company finds the objection justified, it lifts the restriction immediately.

Article 32 (Damages)

1. (1) If a Member suffers damage for reasons attributable to the Company, the Company compensates for it. Damage arising from special circumstances is compensated only if the Company knew or could have known of those circumstances.
2. (2) A Member who causes damage to the Company by violating these Terms must compensate for it.

Article 33 (Disclaimer)

1. (1) The Company is not liable when it cannot provide the Service for reasons beyond its control, such as natural disasters, war or suspension of service by a telecommunications carrier.
2. (2) The Company is not liable for problems using the Service caused by reasons attributable to the Member.
3. (3) A result of hunting, tempering, rolling options and the like that differs from what a Member expected is not in itself regarded as damage. Results of Chance items follow the probabilities posted on the Odds page.
4. (4) Changes caused by updates are governed by Article 15.
5. (5) The Company has no duty to intervene in disputes arising through the Service between Members or between a Member and a third party, and does not compensate for damage from them, except where the Company acted with intent or gross negligence.
6. (6) Unless it acted with intent or gross negligence, the Company is not liable for damage arising from the use of services provided free of charge.

Article 34 (Notices to Members)

1. (1) Matters for all Members are posted on the first screen of the Service and on the Council.
2. (2) Matters for an individual Member are sent by in-game message. Matters that must be kept on record, such as payments and refunds, are also sent to the email address the Member provided.
3. (3) The Company is not responsible for disadvantages that arise because a Member changed their contact details without telling the Company and did not receive a notice.

Article 35 (Dispute Resolution)

1. (1) The Company receives and handles Members' opinions and complaints at incode@gmail.com.
2. (2) If a dispute arises between the Company and a Member, the parties first try to settle it by consultation. If that fails, the Member may apply for mediation to the Korea Consumer Agency (consumer call center 1372) or the Content Dispute Resolution Committee.

Article 36 (Governing Law and Jurisdiction)

1. (1) The laws of the Republic of Korea apply to these Terms and to disputes about the use of the Service.
2. (2) Lawsuits between the Company and a Member are brought before the court with jurisdiction under the Civil Procedure Act.
